The sitter was probably Charles Patrick Daly (October 13, 1816 – September 19, 1899) who was a member of the New York State Assembly, Chief Justice of the New York Court of Common Please, President of the American Geographical Society, and an author of several books.

The New York Times review, which just calls the sitter ‘Judge Daly’, said that the ‘…white beard is made too prominent and weakens the face’ so this cannot be Marcus Daly since Daly was not a judge and wore a white moustache only. Charles Patrick Daly had been painted earlier by Daniel Huntington.
